Sunshine Behavioral Health Services, Corp. is an Applied Behavior Analysis (ABA) therapy provider serving children and young adults across Miami-Dade, Broward, Palm Beach, and Monroe Counties in Southeast Florida. We provide in-home, school-based, center-based, and telehealth ABA therapy services under the supervision of board-certified behavior analysts (BCBAs).

The information on this website is provided for general informational and educational purposes related to our services. It is not a substitute for professional clinical assessment, diagnosis, or individualized treatment recommendations.

A formal clinical relationship with Sunshine Behavioral Health Services, Corp. is established only after a signed service agreement and a completed BCBA assessment.

5. Clinical Services Agreement

The delivery of ABA therapy services by Sunshine Behavioral Health Services, Corp. is governed by a separate Clinical Services Agreement signed at intake. These Terms of Service apply to your use of this website and do not constitute or replace the Clinical Services Agreement.

Key terms governing clinical services — including consent, fees, billing, insurance authorisation, termination of services, and client rights — are set out in the Clinical Services Agreement and associated intake documents provided to each client and their family at the start of services.

In the event of any conflict between these Terms of Service and the Clinical Services Agreement regarding the delivery of clinical services, the Clinical Services Agreement shall govern.

6. HIPAA and Patient Privacy

Sunshine Behavioral Health Services, Corp. is a HIPAA-covered entity. All protected health information (PHI) collected in connection with the delivery of clinical services is handled in compliance with the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the HITECH Act.

Your rights regarding PHI — including your right to access records, request amendments, and receive an accounting of disclosures — are described in our HIPAA Notice of Privacy Practices, provided at intake and available upon request.

Use of this website is also subject to our Privacy Policy, which describes how we collect and use information submitted through website forms.

7. Contact Form Submissions

When you submit information through our website contact forms, consultation request forms, or insurance verification forms, you understand and agree that:

  • Our contact forms are not HIPAA-secure channels. Do not submit detailed medical records, diagnostic reports, or sensitive protected health information through website forms.
  • Submitting a form does not create a clinical or contractual relationship with Sunshine Behavioral Health Services, Corp. A clinical relationship is established only through a signed service agreement following a completed BCBA assessment.

  • We do not guarantee a specific response time, though we aim to respond within one business day.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

Any dispute arising out of or relating to these Terms or your use of this Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Miami-Dade County, Florida. By using this Site, you consent to personal jurisdiction in those courts.

For disputes related to clinical services, please refer to the dispute resolution provisions in your Clinical Services Agreement.

We may update these Terms of Service from time to time to reflect changes in our services, technology, or applicable law. When we make material changes, we will update the “Last Updated” date at the top of this page.

Your continued use of this Site after any changes are posted constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

If a change materially affects your rights under a Clinical Services Agreement, we will provide separate notice as required by that agreement.
